This is not Evidence

The police, and the Ombudsman's office, withheld these from the prosecution. They really like to protect their friends from Justice.

This is what happens when you stand up to a fake residents' group. When I walked down to Donegall Pass, leaving a trail of bloodspots on the way, the police sent the ambulance away. I was taken into a small room where a number of officers proceeded to bully me. I was told not to press charges and cautioned for the crime of criticising Katrina O'Neill. They falsely claimed that many public representatives have used the harassment legislation to silence their critics. It would be correct to say, however, that this law exists to stifle dissent. It has been used repeatedly by corporate interests to prosecute those who expose their evil deeds.

It is hard to deny that the police have endorsed the violence inflicted upon me. They refused to investigate for six months until I revealed the false name used by my assailant and his puppetmaster, Miss O'Neill. When the police finally went through the motions they cautioned me with the usual counterallegations and insisted the photographs were inadmissable.

For eighteen months a disk, and evidence statement, have languished in the care of the Ombudsman's office who insist they are for their own use and not to be passed over to the PPS. They have even tried to rewrite the Rules of Evidence, an affront to the intelligence of any criminal counsel.

The attack on me two years ago was attempted murder. Had it happened as planned, on a dark night rather than in broad daylight, I would be dead, Mr Catney would be walking free, as he is now after perjured evidence got him acquitted. And an act of instrumental violence would have made it clear that you do not criticise certain people. The various bogus allegations made by Miss O'Neill and her extended family would have posthumously smeared my name.

I am alive yet live forever in the shadow of death, waiting for a police informer to finish what he started. Every day I live is revenge.

you are insulting, patronising and stupid this could have been anyone.

belfast samizdat said...

You'll have to do better than that.

Look at the photographs. Repeated and systematic strangulation. Attempted murder.

Is it any wonder the cops kept the photographs out?

The look after their "special friends". And they sure as fuck don't like anyone who stands up to them.

Remember they prosecuted me for criticising these people. They refused to investigate for six months. Such failure is called an "abuse of process". The Ombudsman, who refuse to release their own copies of the photographs along with their evidence statement, have prepared a "misconduct file" in this case.

I'm afraid it goes beyond mere misconduct. Withholding or excluding evidence is Perverting the Course of Justice. According to the law the Ombudsman and Police are both guilty of Perverting the Course of Justice.

Feel free to retort with silly insults.

Holylands man. Thats quite a crazy story and set of photos. I believe you. But it's pretty crazy the trouble your getting into through your campaign.

If it's any consolation, I'm moving into the holylands next year and I was planning on going mental all year, but after reading your blogs I'll make sure to be considerate.

Any chance of changing one of those 'Edit me's on your link section to link to my blog instead?

A 20 Point Plan to save the Holylands:

1) NO NEW HMO'S SHOULD BE GRANTED

2) HOUSING EXECUTIVE SHOULD BUY A SIGNIFICANT AMOUNT OF EXISTING PROPERITES FROM PRIVATE LANDLORDS

3) PRIORITY SHOULD BE GIVEN TO FAMAILIES IN THE ALLOCATION OF THE HOUSES

4) 1ST YEAR STUDENTS SHOULD BE FORCED TO STAY IN HALLS OF RESIDENCE: THIS SHOULD BE STRICTLY ENFORCED

5) UNIVERSITY DISCIPLINE REPRESENATIVES SHOULD PATROL THE HOLYLANDS LATE AT NIGHT WITH THE WARDENS ON A REGULAR BASIS

6) A COMMUNITY HOUSE SHOULD BE ESTABLISHED AS A BASE FOR COMMUNITY ACTIVITY, MEETINGS AND SOCIAL EVENTS

7) A COMPREHENSIVE LIST OF STUDENTS LIVING IN PROPERTIES SHOULD BE CREATED AND CONTINUALLY KEPT UP TO DATE

8)ALLEY GATES AND CCTV SHOULD BE INSTALLED

9) A POWER OF EVICTION SHOULD BE CREATED BY THE COUNCIL FOR PROBLEM ADDRESSES

10) REVENUE FROM FINES GENERATED BY THE UNIVERSITY SHOULD BE DIRECTED BACK INTO THE COMMUNITY

11) THE PROBATION SERVICE AND SOCIAL SERVICES SHOULD PROVIDE CONTINUAL STATISTICS RE: PLACEMENT OF ANTI-SOCIAL ELEMENTS IN THE AREA

12) LANDLORDS SHOULD BE MADE TO SIGN A CO-OPERATION AGREEMENT IN WHICH THEY AGREE TO KEEP ACURATE RECORDS OF TENNANTS AND FORWARD RELEVANT INFORMATION TO ANY RELEVANT AUTHORITY

13) FINES FOR LANDLORDS SHOULD BE INTRODUCED IN RELATION TO PROBLEM PROPERTIES [IF THE LANDLORD OWNS 5 OR MORE PROPERTIES IN THE AREA]

14) A PANEL OF ALL INVOLVED PARTIES AND AGENCIES SHOULD MEET MONTHLY TO ASSESS SPECIFIC CASES OF ANTI-SOCIAL BEHAVIOUR IN A COHESIVE MANNER

15)HOUSING EXECUTIVE ANTI-SOCIAL BEHAVIOUR CO-ORDINATORS [YES THEY DO ACTUALLY EXIST] SHOULD BE INVOLVED IN THE ABOVE

16)INSPECTIONS OF STUDENT ACCOMODATION SHOULD BE CONDUCTED BY UNIVERSITY WELFARE OFFICERS AT LEAST ONCE EVERY TERM. FINES SHOULD BE ADMINISTERED FOR SUB STANDARD ACCOMODATION

17) COMMUNITY SERVICE SHOULD BE INTRODUCED BY THE UNIVERSITIES AS AN ALTERATIVE SANCTION. GARDENS SHOULD BE CLEANED AND LITTER PICKED UP BY PERSONS DOING THIS IN AN IDENTIFIABLE MANNER

18)STUDENT UNIONS AND THE RESIDENTS COMMITTEE SHOULD HAVE A MEANINGFUL FORUM FOR DISCUSSION

19)RELATIONS BETWEEN RESIDENTS AND STUDENTS SHOULD BE FOSTERED BY A "KNOW YOUR NEIGHBOUR" CAMPAIGN IN WHICH STUDENTS SHOULD BE ENCOURAGED TO CALL WITH NEIGHBOURS [OR VICE VERSA] AND INTRODUCE THEMSELVES

20) THE POLICE OMBUDSMAN SHOULD LAUNCH AN INVESTIGATION REFERENCE FAILURE IN DUTY OF THE POLICE AUTHORITIES IN THE AREA. APPROPRIATE DISCIPLINE ACTION SHOULD BE SOUGHT.

I KNOW HALF OF THE ABOVE IDEAS WOULD NEVER BE CONSIDERED OWING TO THE FACT THAT NOBODY WITH ANY POWER TAKES OWNERSHIP OF THE HOLYLANDS....BUT STILL...IF SOME OF THEM WERE BROUGHT IN THEN IT'D START TO MAKE SOME DIFFERENCE.

I HAVE A SUSPICION THAT MANY OF YOU [INCLUDING ALAN] WILL SIMPLY RUBBISH ALL THE IDEAS AND GIVE THE WARCRY OF "THE HOLYLAND'S DOOMED...FAMILIES CAN'T LIVE THERE ANYMORE ETC ETC" BUT BEFORE YOU DO CONSIDER TWO POINTS:

1) THE HOLYLANDS AIN'T THE WORST PLACE TO LIVE IN BELFAST....GO TO ANY BLOCK OF HIGH RISE FLATS IN GREATER BELFAST AND YOU'LL SEE WHAT I MEAN. PEOPLE THERE WOULD MOVE HERE IN THE DROP OF A HAT.

2)IT'S THE EASIEST THING IN THE WORLD TO RUBBISH IDEAS WITHOUT PRESENTING ALTERNATIVES. SO LET'S HAVE SOME IDEAS FLOATED ABOUT. THE HOLYLANDS IS GOING TO GET EVEN WORSE FOR RESIDENTS AND STUDENTS IF BOTH PARTIES DON'T START TO THINK SMARTER ABOUT THE LARGER SITUATION....I'D RATHER LIVE BESIDE A NOISY STUDENT THAN A CAR THIEVING JUNKIE WHO'D STICK A KNIFE IN YOU AS SOON AS LOOK AT YOU.

belfast samizdat said...

Finally, meaningful debate. Thank you Holyland scribe.

To cut a long story short, you cannot save that which no longer exists. Six years ago the Extern organisation found 204 residents besieged by 5,500 "students". Today you will not find much more than 50. The number of "students" is estimated to be anywhere between 6,000 to 8,000.

A handful of disparate people outnumbered 100 to 1 is not a community. In order to role back studentification you must acheive a situation where residents outnumber students by at least 10 to 1. This cannot happen in the Holyland. I do not rule it out for other areas, but their front line is not here. It is on their own doorstep and coming through their own party walls.

Should the Housing Executive spend money vesting properties? In a word, no. Here are the reasons why:-

- Cost. Market values, even in these times are way beyond the price of a new build. THat's just to purchase the building. Converting former HMO's or alternatively derelicts involves gutting the building. This alone is more than the cost of system build.

- Social sustainability. You cannot create a community in the Holyland. Once again, I do not rule it out for other areas, but the Holyland is a student area. Declan Boyle's cynical boast is correct. Families do not want to live in or move into a student area. They should not be expected to.

-Environmental Sustainability. Old houses consume vast amounts of fuel. Families cannot afford this. Fortunately there is an alternative. The Germans call it "Passivhaus". It's their new building standard, recently adopted by the South. These houses capture solar energy to heat themselves all year round. They are not overly expensive to build (+12%)and can be adapted to system build, thus bringing costs down dramatically. Per unit they are are at least twice as economical to build as buying and converting old houses.

-Pouring tens (at least) of taxpayers' millions into the Holyland is like bailing out the Titanic.

First year students will never be forced to live in halls of residence. End of.

Alley gates and CCTV. The East German solution. This kind of thing will never be used against "students". Remember Trevor O'Neill's infamous boast that there is "no student criminal behaviour". Residents will be watched very closely with the usual hostility. There will be exceptions; the prison trustys who will be allowed to commit attempted murder and get away with it. CCTV footage of their violence will become "unavailable".

The various "partnership" measures you suggest will be used as a smoke screen for the rape of the community.

I cannot think of a worse place to live in Belfast. It does, as it happens, contain car thieves, junkies, and people who will stab you. Gerard Catney, for example, stabbed a student eight years ago, while he and Katrina were living in Cairo street. These two partners in malice have moved in behind me. They have unseen access via the entry to the back of my house. I'll still choose Lavinia over the Holyland.

On that note I want white cherry blossoms for my funeral wreath.

"surely if these people were going o harm you it is nothing more than sheer stupidity to antagonise them?"

That's a non-sequitur. If they're going to harm me it's a done deal. Neither antagonism nor appeasement will make a difference.

However, when you're dealing with bullies and thugs it's important to be defiant. You may feel fear, but don't show it, even when your head's being bashed off the pavement.

Holyland Scribe said...

Actually after considering the points I made I'm willing to accept that residents are now in an untennable position.

The community is gone and the measures needed to transplant a community back into the area are logistically unrealistic. For a City that can't even organise a visitors centre for the titanic to contemplate changing the Holyland is laughable.

However I would say this....remaining residents who have bought their homes have done well out of it owing to the inflated prices in the area. They can afford to move if they wish.

The residents in social housing however are stuck in a nightmare. As a measure of good will the housing executive should re-home long standing residents.

This, by the way, would also solve the problem of spending hundreads of thousands on anti-social behaviour programmes and residents liason.

Exit strategy for long term residents can be the only decent thing to salvage from the mess.

The Holylands has become the pinnacle of consumerist individualism. It is the playground of Thatcher's children....let's remove the adults from it and watch the whole thing collapse on itself...it'll be like Lord of the Flies!

I have a theory and it is this, you don’t have many friends and when you’re at home alone (all alone) you find yourself compelled to talk to people but you’re not a nice guy. You’re a creepy guy and this is demonstrated through your photos. So in a bid to converse with other people you tell them you hate them. This will compel the defensive people to reply to this comment. This in fact positively re-enforces you bad behaviour and drives you to write more angry blogs to get more replies. What do you think is this an accurate theory?

belfast samizdat said...

In reply to anonymous, I have to say that your painfully limited knowledge of psychology is sufficient to graduate you from Queens. You should enroll. You wouldn't even have to go to class. Then again half the undergraduates on that course don't anyway, so you won't be alone in your absence.

To Holyland Scribe, I'm glad you understand. The area really is catastrophic. There is no hope for it.

Alan uses his bloggy persona to say things that he would never say in real life, he uses it and exercises complete control over the blog, in order to create an idealised self.
Alan also uses his bloggy persona to attempt creativity, writing long and indulgent pieces. Even the thought of someone reading this thrills him.

Also, bloggy will tolerate no backchat and any attempt to disagree will be sidestepped or ignored.....known as DENIAL

Alan,

How many degrees have you attempted to do now? I know its few? If you don't need to turn up to do a degree at Queens how can you continue to struggle? I don't understand, please explain this to me.

It’s nice that Clanmill has given you a brand new two bedroom home, when you're a single man with no kids and no one else? When I saw this I completely understood why you were so angry with the housing authorities and private landlords (even though Clanmill is a housing association, which is a government supported and subsidised landlord with more house that Declan Boyle). I suppose it doesn't matter when you aren't paying the rent, isn’t that right?

Are you still unemployed, I can never tell as you're always come home in the evening like you've been on a building site?

I agree students in the Holylands have no respect for the place in which they live. The landlords have destroyed the place; however one of your mates couldn't wait to be one the minute they got the chance. Was one of her tenants involved in the Holylands madness and if so did she kick them out?

If all you wanted was peace and quiet then why did you head straight to the Holylands the minute trouble kicked off instead of staying in your nice new property? I don't understand this either, please explain.

belfast samizdat said...

Ah the cheap personal jibes! What would I do without them? Demolishing them is a form of mental exercise. Pilates for the brain.

I'm struggling with just the one degree. Now that's a story.

I fell in love with Queens, back when it was a university. I should have gone there then; student grants and no tuition fees. And it was real academia.

Alas it is no more. The academics quietly call it a meat grinder. The ones who get ground up are those who care and want to learn and grow and contribute. If I simply didn't give a fuck there'd be no problem. Go through the motions and get your 40%. This is a UK wide phenomenon. It's not unique to Northern Ireland.

I do care. My name is Alan and I'm an addict. I'm addicted to learning and understanding. Jeffrey Schaler would argue that our addictions are what make life worth living. Of course some are more productive than others. I can see no merit in addiction to crack or nicotine, but what if you're addicted to books or paintings or creativity?

Queens is singularly hostile to those who are conscientious and want to learn. This is a common complaint. Anything that clogs up the production line is intolerable.

This has it's wonderfully absurd side. Level 2 psychology is a mass of irrelevant horseshit. Most of it is way out of date and has not changed in the nine years that I have been there. There is so much crammed into it that people can't cope, unless all you want to do is scrape a 40%. Some years ago they went from six full modules to twelve half, almost doubling the workload. I can recall a lecturer calmly telling me that

"We had fewer breakdowns with full modules"

Remember, these are psychologists. They're supposed to know what they're doing to people's heads.

I escaped level two (eventually) without a breakdown. Whooopee!!!
However, the point has been made; you do not want to give a fuck. It's bad for your health.

Fortune smiled at me when a single man wanted to swap a two bedroom house for my Jerusalem Street hovel. It's not a redemptive ending you understand, not for him and not for me now that the queen Bitch of Malice and her Psycho boyfriend have moved in behind me. It was awfully good of Ulidia Housing Association to let them abuse a single parent house for all those years before they finally had to move on. I suppose they'd become an embarrassment. Homicidal violence does that.

It's nice to know you're keeping close tabs on my comings and goings. You might consider getting a life.

I popped over to the Holyland to witness our yearly cultural spectacle a mere ten months after I'd moved out.

I hope this answers all your questions. Feel free to get back to me.

addicted to creativity?

Anonymous said...

So you’ve been there for nine years now, how good and you're still struggling to get your head around 2nd year psychology its beyond belief. You need 40% to pass each module which you can gain by demonstrating a little understanding of the subject and by writing in a fluent manner. The spelling, grammar and referencing don’t even have to be that good. So how can you continue to struggle, it's just so strange and depressing at the same time.

I would be angry with a university who passed people who I believed to be inferior and continued to take my money year after year. I would imagine you’ve given the university somewhere in the region of £22,000 in tuition fees over the past nine years that’s alot of debit to get into and still see no sign of any degree. I would be questioning why? have you got feedback from your lectures and tutors. I would hope you have, what are you doing in your tutorials. Do you express your views on subject matter to the tutors and look for understanding among your class peers. Why are they not aiding you to understand the theoretical thinking behind psychology. I find that it’s all just so bloody depressing I can’t speak on this subject anymore. Keep your chin up, some day you’ll be accepted as a Queens academic, until then you will just have to watch the young 21 year olds in your class do it before you.

Ah, people who watch you should get a life. Coming from the same guy who moves around the corner from a woman with young kids who he has previously harassed and bullied. You have surfed bebo and other sites to see what young people do with their spare time and write reports on landlords & your neighbours. I don’t believe that you are in any position to tell anyone to get a life. I think when a person is going about their day to day life and observes a privately educated bully, who picks on working class women and young foolish kids. Then it is the job of that community to ensure that the bully is aware that he is being monitored.

I will take it that your silence in regards to question on you employment status means that you are unemployed. Yet, you have failed to explain to the readers of this blog why you come home in the evening looking like you’ve been out working. I wonder why?

It’s good to see that you don’t care that you’ve taken a family home from those who need it even though you are the only person in the aforementioned two bedroom home. The privatising of social housing really doesn't matter to you now does it Alan. No comment of your reporter friend either, isn’t that surprising. I thought you hated landlords. Is she the Holylands Scribe?

belfast samizdat said...

Most of those nine years were spent on temporary withdrawals for health reasons. Living in the Holyland and surviving an attempt on my life might have something to do with that.

Spare me the righteous indignation about the Drama Queen and her lies. It didn't stand up in court and people round here know what kind of a creature she is. After all she didn't last too long in Essex Street did she? Courtesy of her boyfriend's defense counsel we now know she is an informer. Her vendetta against me has gone on for two and a half years and all because I criticised her for her failings in her public role.

And spare me the horseshit about "taking a two bedroomed home". At least I don't call for families to be forced to rent from private landlords. She tried to have me killed because I objected to that.

I'm still here. And no I'm not out working. Your uniformed friends watch my every move, and they'd have a hell of a job justifying that claim. They protect the Drama Queen and her boyfriend so it's useless anyone reporting them. It would be beneath my dignity to try. She may be a tout. I will not lower myself to her level.

Anonymous said...

Sorry, did I hit a sore point. I wonder why? Temporary illness was it, I'm glad you're better. We don't want the crazy people running the asylum now do we?

Alan, this life threatening attack you suffered is also looking slightly shaky and I’ll tell you why. I see one cut to the left side of your head, which I would imagine was done by the ground when you fell and struck the pavement or a solid object on the way down (clearly very dangerous, I won't disagree). The clearly visible black eyes would have been caused from a single strike to the right hand side of breach of the nose which would blacken both inner corners of the eyes, but more excessively the right. Your T-shirt is wrinkled on the left side and slightly stretched which would indicate that you were held down on a hard surface and the bruising to the collar bone and chest area would back this up as you would have been struggling to cover your face while on the ground. Your attacker pushed hard into your upper chest and collar bone. This was to ensure that he could punch you and maintain control of you. The strike would have been as you were looking away in an attempt to cover your mouth and nose. I'm sure it was all very scary and hitting the ground was dangerous, but your photos would suggest a fall to the ground (somehow) and you were then held down and punched once. It wouldn't appear to be a full out attack or sustained attack. There is no bruising to the stem of the neck to indicate strangling or extra bruising to the head or other bodily regions which would show a number of punches making contact?

Alan, I'm amazed you can recall
every word you said and every word your attacker said. In a moment of extreme violence the human body goes into shock and works on survival mode. Victims find it nearly impossible to remember anything that was said during or after an attack. Unless there was a period of calm during the attack. This wouldn’t make sense according to your version of events as it was extremely violent and you were nearly dying. I suggest that you are making up the ferocity of the attack. I would believe the comments were said during a moment of rage from a man who felt his female partner was under threat.

belfast samizdat said...

I didn't know you were a forensic pathologist. Maybe you've been watching too much CSI. It's not real you know, it's television.

There is multiple finger marking around my neck, and substantial bruises indicative of a very tight neck vice. The bruising round my head took a week to develop fully and the report of the GP's examination six days after is scary reading. Multiple blows to the head, arms and torso. Systematic repeated strangulation.

Very little was said so there's not much to remember.

I have depression and anxiety. That's no secret. Being tormented by "students" and encouraged to report them by a dipso con-merchant called Anne Monaghan really fucked things up. Having built her career on the pain of a dying community she now feeds off dying children. Fucking Ghoul. Sooner or later people are gonna wake up to her lies. Dead children can't complain, but she only has to drop her guard once for the parents to see through her. It must be stressful keeping that front up.

'The bruising round my head took a week to develop fully and the report of the GP's examination six days after is scary reading. Multiple blows to the head, arms and torso. Systematic repeated strangulation'

If there was more bruising I would expect you (being the smart guy you are ) to have photographed it, however you didn't I wonder why. A doctor will write what you told him caused the bruising to your body they won't make their own judgements. Thats why when they come across a child with injuries they will contact social services and report suspected abuse, as they will not make judgements on how the child has been injured, however you haven't attached the doctors report to this blog so we can't read it to inspect it.

The finger marks only go as far up as about an inch above the collar bone and as I stated before that is from the pressure being used to push you down. You story has been extended to make you sound like a serious victim.

belfast samizdat said...

I gather you still think you're a forensic pathologist.

The photographs taken on day 7 are analogue and poor quality. They add nothing that cannot be extrapolated by a proper doctor (as opposed to someone who confuses television with reality, and thinks it qualifies them to make medical judgments).

You also haven't addressed the finger marks. These are clearly visible and would subsequently develop very nicely.

It is not my prerogative to publish medical records. However, you could talk to those who saw my injuries. There is no shortage of them, but for members or associates of the O'Neill/Catney crime clan to go around doing so is clearly intimidation.

After all, nobody wants to get into trouble with these people the way I did.

I look forward to your latest installment of CSI inspired wisdom.

I can produce many statements from people claiming that they have seen little green men, it doesn't make it any more reliable. I am going of YOUR PHOTOS and they don't back up your story. You don't even have petechiae (red spots) in the eyes which is a sign of serious strangulation. I'm sure your doctors report won't have it either. I'm away to watch some CSI now.

I think I'll let you know now, I have no further desire to converse with you any longer. You are boring and selectively answer some questions and fail to answer others. I can understand why no one likes you. Good luck with you studies and keep living the dream.

I've escaped from the Holyland. I agree that there's no hope for the place. Alistair McDonnell's comments in the latest South Belfast News are correct. Nothing can be done with the place.

The HMO cap of 30% guarantees the destruction of target communities. Anything above 9% is unsustainable. the community is destabilised and spirals downward.

The handful of remaining residents should be offered new-builds nearby. The Housing executive should adopt the Southern building standard and, crucially, be allowed to build again. The new housed heat themselves all year round by storing solar energy. It sure beats the massive heating bills in the Holyland.
